Last year’s conference featured a lively session on whether loan funds should be regulated. While no conclusions were reached, there seemed to be an emerging consensus that the issue may be less whether than how, and that the industry needed to participate actively in shaping regulation that accomplished the good and avoided the ugly. In the intervening year, we have experienced the opportunities and challenges of piecemeal regulation through, among other things, the SBA Community Advance Program, the CDFI Bond Program, and Federal Home Loan Bank membership. Other loan funds are meeting regulation through their participation in consumer finance. This panel will continue last year’s discussion, with the benefits of this year’s experience, and focus on what loan funds might want to accomplish through regulation, what kind of regulation, and by whom.
